What you need to know about contracting in the Netherlands
In principle, you are free to decide whether you want to work as a self-employed or an employee. However, if you choose to work as self-employed, you must comply with three conditions according to the law on employment relations. If these conditions are not met, you are required to conclude an employment contract as an employee. You must do so to avoid false self-employment (schijnzelfstandigheid).
The 3 conditions to be considered self-employed are:
- You are free to determine your working hours.
- You decide how you organize the work.
- There must be no possibility of hierarchical control.
